Nowadays, internet-based devices conquer even our workplaces. Consequently, more and more data protection issues arise, expressing a definite demand to have legal arrangements in this respect.

I think there is a world market for maybe five computers.
Thomas Watson, IBM President, 1943
As from 1 January 2012, a new data protection act entered into force.

Save for just a few exemptions, data processing (registering, storing or transmitting personal data, using personal data for advertising purposes, etc.) can be pursued only in possession of the preliminary consent of the respective individual or based on legal prescriptions, i.e. in case of compulsory data management.

Data processing must be reported to the National Authority of Data Protection (NAIH) prior to starting such operation.

With respect to data protection law, we provide services to our clients in the following issues:

  • consultancy in data protection issues;
  • drafting and/or review of data protection by-laws and regulations, completion of the reporting obligation towards NAIH;
  • monitoring on data processing systems, legal compliance study;
  • legal representation in front of the data protection authority in all respective procedures.
